Privacy Policy
This Privacy Policy explains how SOFX, Inc. ("SOFX," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit our website, purchase or take the Wired to Win assessment, receive your reports, or use any related products or coaching services (together, the "Services"). It also describes the choices and rights you have regarding your information.
Wired to Win is a research-grade behavioral and career assessment delivered online. Because the assessment involves answering questions about your behaviors, motivations, and preferences, we take the handling of that information seriously. Please read this Policy carefully. By using the Services, you agree to the practices described here.
1. Who We Are and Scope of This Policy
SOFX, Inc. is a United States-based company and is the controller responsible for the personal information described in this Policy. This Policy applies to information we collect through our website and Services. It does not apply to third-party websites, products, or services that we do not control, even if they link to or from our Services.
2. Information We Collect
We collect information in the following categories:
- Information you provide directly. Your name, email address, billing details, and any information you enter when you create an account, purchase a tier, contact us, or sign up for communications.
- Assessment responses. The answers and inputs you provide when you take the Wired to Win assessment.
- Assessment results and profile data. The behavioral and motivational profile generated from your responses, including your DISC behavioral results and 12 Driving Forces (motivational) results, and the personalized reports created from them (for example, your Behavioral Report and Career Strengths Report).
- Payment information. When you make a purchase, your payment is handled by a third-party payment processor. We do not store full payment card numbers on our own systems; we receive limited transaction details such as confirmation of payment, the last digits of a card, and billing contact information.
- Coaching and scheduling information. If your tier includes live 1:1 coaching, we collect scheduling details, session-related notes, and any information you share during sessions.
- Communications. Records of your emails, support requests, and other correspondence with us.
- Automatically collected information. Device and usage information such as IP address, browser type, pages viewed, referring pages, and similar data collected through cookies and analytics tools (see Section 7).
A note on sensitive information. Your assessment responses and the resulting behavioral and motivational profile may be considered sensitive or personal information under certain laws because they describe characteristics about you. We use this information only to deliver and improve the Services you requested, as described in Section 3, and not for unrelated purposes.
3. How We Use Your Information
We use the information we collect to:
- Provide the Services, including scoring your assessment and generating and delivering your reports, guidebook, and AI prompt library;
- Process payments and provide order confirmations and receipts;
- Schedule, deliver, and follow up on coaching sessions (for applicable tiers);
- Create and manage your account and authenticate you;
- Respond to your questions and provide customer support;
- Send you transactional messages (such as receipts, report delivery, and scheduling) and, where permitted, marketing communications you can opt out of;
- Maintain, secure, troubleshoot, and improve the Services;
- Detect, prevent, and address fraud, abuse, and security incidents; and
- Comply with our legal obligations and enforce our agreements.
We do not use your assessment responses or profile data to make automated decisions that produce legal or similarly significant effects about you.
4. Legal Bases for Processing (High Level)
Where required by law (for example, for users in the European Economic Area, United Kingdom, or similar jurisdictions), we rely on one or more of the following legal bases to process your information:
- Performance of a contract to provide the Services you purchased;
- Consent for certain activities such as optional marketing or, where applicable, processing of sensitive information (you may withdraw consent at any time);
- Legitimate interests to operate, secure, and improve our business in ways that are not overridden by your rights; and
- Legal obligation to comply with applicable laws.
5. How We Share Your Information
We do not sell your personal information for money. We share information only as described below:
- Service providers. We share information with vendors who perform services on our behalf, under contracts that limit their use of the information to those services. These include a payment processor (to process your purchase), an email and delivery provider (to send reports and communications), and analytics providers.
- Assessment instrument provider. We work with TTI Success Insights, the provider of the validated DISC and 12 Driving Forces instruments that power Wired to Win. Your assessment responses are processed through their platform to generate your results and reports, subject to their own terms and privacy practices.
- AI provider. Certain features, such as the AI prompt library, may use a third-party artificial-intelligence provider. Where this occurs, we limit the information shared to what is needed to deliver the feature.
- Coaches. If your tier includes coaching, your coach (which may include our founder, Sam Havelock) may access your reports and relevant profile information to prepare for and conduct your sessions.
- Legal and safety. We may disclose information if required by law, legal process, or government request, or to protect the rights, property, or safety of SOFX, our users, or others.
- Business transfers. If SOFX is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to this Policy.
Some of these disclosures to analytics or advertising partners may be considered "sharing" or a "sale" under certain U.S. state laws. See Section 9 for how to opt out.
6. Data Retention
We keep personal information for as long as needed to provide the Services and for legitimate business and legal purposes. In general:
- Account, purchase, and tax/transaction records are kept for the period required by applicable financial and legal rules;
- Assessment responses, results, and reports are retained so you can access them and so we can support you, unless you ask us to delete them; and
- Marketing contact information is kept until you unsubscribe or ask us to delete it.
When we no longer need information, we delete or de-identify it. Specific retention periods are determined based on the type of data, the purpose for which it was collected, and legal requirements.
7. Cookies and Analytics
We and our analytics providers use cookies and similar technologies to operate the website, remember your preferences, measure traffic, and understand how the Services are used. You can usually control cookies through your browser settings, and where required we provide cookie controls or a consent banner. Some features may not function properly if you disable certain cookies.
8. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, and unauthorized access. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
9. Your Privacy Rights
California residents (CCPA/CPRA). Subject to certain exceptions, you have the right to:
- Know/Access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties with whom we share it;
- Delete personal information we have collected from you;
- Correct inaccurate personal information;
- Opt out of the "sale" or "sharing" of personal information (we do not sell your information for money, but some analytics/advertising activity may qualify as "sharing");
- Limit the use of sensitive personal information to what is necessary to provide the Services; and
- Not be discriminated against for exercising your rights.

Users outside the United States (GDPR-style rights). If you are in a jurisdiction that grants such rights, you may have the right to access, correct, delete, restrict, or object to processing of your personal information, to data portability, and to withdraw consent. We will respond to rights requests within the timeframes required by applicable law.
10. Children's Privacy
The Services are intended only for adults aged 18 and over. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us at admin@sofx.com and we will take steps to delete it.
11. International Data Transfers
SOFX is based in the United States, and the information we collect is processed and stored in the United States and in other countries where we or our service providers operate. If you access the Services from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. Where required, we use appropriate safeguards for such transfers.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Policy.
